In a tragic incident, an employee of Trackline (International) Ltd was killed when his forklift truck toppled over and crushed him underneath. The incident has prompted the HSE to issue a warning to all companies to manage their in-factory transportation in a better manner.
The company was fined ₤7,500 and ₤6,690 as costs at Lincoln Crown Court, after it pleaded guilty to the charge of failing to comply with section 2(1) of the Health and Safety at Work Act 1974. It was found lacking in proper safety measures, factory organisation and proper planning in relation to load-handling arrangements by forklift trucks.
The incident occurred when the driver of the truck, Shaun Porter, was moving a heavy steel assembly at the company’s site, where it assembles earth-moving equipment. A large framework was protruding into the unmarked gangway where he was driving. Colleagues noticed that he would collide with the framework and shouted for him to stop. Unfortunately, as Shaun tried to brake and stop, the load he was carrying hit the frame, causing the truck to spin and overturn. Shaun tried to get out but was crushed under the weight of the truck, which killed him instantly.
The coroner’s report indicated the cause of Porter’s death as the crushing of his internal organs. In its investigation, the HSE found that lack of clearly defined routes for use by forklift trucks and employees, and of guidelines for assessing loads for transportation. Employees were also found to be moving around on unofficial routes, as there was no proper gangway inside the facility.
